in CA, can i sell to public, cupcakes made in commercial kitchen, but frosting is made residentially?
can I legally buy cupcakes without frosting from a commercial vendor. then make the frosting in a residential kitchen and then sell the cupcakes to the public? what all is required of me legally – California

technically, no. I know its incredibly stupid but there are lawsuits against this. You could lie and say you baked the cupcakes yourself, but if someone happens to let’s say work at the place you originally bought the cupcakes from, tastes it, and realizes that those are her company’s original cupcakes (minus the frosting) you could get in serious trouble.
It’s like printing an image off Google and selling it; it’s not your image, it belongs to Google, and if you wanted to sell it you had have to have permission from Google; just like you would need permission from the original cupcake company.
So yes, you CAN get away with it, but if you don’t want to risk getting caught, which would honestly be slim to none, than I would just bake your own cupcakes.
This is why I hate politics -_-
